The intention of a StateMachine is, that only the TypeDefinition contains the meta data (the States and Transitions), whereas the instances only contain the current state.
This is the only sentence I could find in the annex:

Therefore we distinguish between StateMachineType and StateMachine and their subtypes like FiniteStateMachineType. The StateMachineType specifies a description of the state machine, that is, its states, transitions, etc., whereas the StateMachine is an instance of the StateMachineType and only contains the current state.

It would be desirable to add a statement that as a consequence States and Transitions shall not have a ModellingRule (which is implied by the statement).
